Removal of Conditions

If you are already divorced, you can file the Form I-751 at any time, including well before the 90 days. This is called a Waiver of the Joint Form I-751.  You attach joint documents and declarations. Because you are divorced, you should include STRONG evidence of your valid marriage prior to the divorce.

If you are placed in removal proceedings, the Immigration Judge can only review the application(s) that were filed with the USCIS, and not newly filed ones. This is why it is imperative that you file correctly so that you can preserve all of the grounds to have your petition approved.
