On April 25, 2015, the U.S. Supreme Court confirmed the equal protection of same sex marriage in the landmark case of Obergefell v. Hodges. However, since June 26th, 2013, the USCIS and all US immigration officials have recognized same sex marriage for immigration purposes. This was in response to the US Supreme Court's decision striking down the Defense of Marriage Act ("DOMA") as unconstitutional. Despite these decisions, LGBTQ couples face unique obstacles in the green card process. Mr. Cardenas is highly familiar with these issues and how to approach and resolve them.
