In May 2026, USCIS issued a policy memorandum emphasizing that adjustment of status remains a discretionary benefit and that officers may consider a variety of factors when deciding whether to approve a case. While the memorandum does not change the law or eliminate adjustment of status as a pathway to permanent residence, it serves as an important reminder that applicants should be prepared to address their immigration history, prior filings, and any issues that may arise during the interview process.
