The U.S Immigration and Customs Enforcement agency is being sued by a family of Mexican immigrants living in Utah, over claims that agents used excessive force when entering the family’s home on two occasions. According to the family, the agents used a battering ram to gain entry to their home, ransacked the apartment, and refused to show a warrant, instead of informing the family that they watched too much television. Nine family members were at home when the two raids took place in April 2017, including four small children who were, allegedly, traumatized by the events. In addition to a 48-year-old grandmother who was arrested and faces deportation, the family members living in the apartment include the four children, who are all U.S citizens, and four adults who are permitted to stay under the Obama Deferred Action for Childhood Arrivals scheme.

Deportation Defense in Salt Lake City

The suit relating to the raids on the home of the Carmona family, outlined above, has been brought by the American Civil Liberties Union of Utah, who describe the events as an embodiment of heavy-handed immigration processes encouraged by President Trump. As an undocumented immigrant with no criminal record, Mrs. Carmona would generally be left alone under the previous administration, rather than having her family put through such a traumatic ordeal.

To illustrate their point, the ACLU stated that:

  • Between October and December 2017, 65% of ICE arrests were criminals, compared to 82% over the final three months of the Obama administration
  • Arrests of criminal immigrants have increased by around 25%, but those relating to non-criminals have leaped by a massive 300%

According to the suit, aside from the emotional impact on the family and, in particular, the young children, the ICE raids on the Carmona home resulted in significant property damage, with agents also taking almost $3,000 which Mrs. Carmona had been saving to pay an immigration attorney.

Securing the Legal Representation of a Salt Lake City Deportation Defense Attorney

Hopefully, any contact you and your family have with ICE will be considerably less traumatic than that of the Carmona family, but you will still require expert legal representation. A Salt Lake City deportation defense attorney could represent your best chances of being permitted to stay in the United States, and continuing with your everyday life alongside your friends, family, and colleagues.

Depending on the specifics of your circumstances, your Salt Lake City deportation defense attorney will decide on the best course of action for you, which may include:

  • Request for prosecutorial discretion to terminate or administratively close proceedings
  • Waivers of inadmissibility and removal
  • Cancellation of removal for permanent residents
  • Cancellation of removal for non-permanent residents
  • Suspension of deportation
  • Adjustment of status to permanent residence
  • Asylum and withholding of removal
  • Legalization and registry
  • Voluntary departure
